1. introduction

welcome to arbor! these terms of service ("terms") govern your access to and use of arbor's website at https://arbor.xyz, our web application, and related services (collectively, the "services"). the services are provided by arbor, inc. ("arbor," "we," "us," or "our").

by accessing or using the services, you agree to be bound by these terms. if you do not agree to these terms, do not use the services.

if you are using the services on behalf of an organization, you represent that you have the authority to bind that organization to these terms, and "you" refers to both you and that organization.

arbitration notice: except for certain types of disputes described below, you agree that disputes between you and arbor will be resolved by mandatory binding arbitration, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.

2. eligibility

you must be at least 13 years old to use the services. if you are between 13 and 18 (or the age of legal majority in your jurisdiction), you must have your parent or guardian's permission to use the services.

3. account registration

creating an account

to use the services, you must create an account. you agree to:

• provide accurate and complete information
• maintain and update your information
• keep your account credentials confidential
• notify us immediately of any unauthorized access
• be responsible for all activity under your account

account security

you are solely responsible for maintaining the security of your account credentials, including your password, authentication tokens, api keys, and daemon pairing tokens. do not share your account credentials with others.

4. subscription plans and billing

subscription tiers

arbor offers the following subscription tiers:

• guest (free): 100mb storage, access to all ai models
• premium: 10gb storage, priority support
• supporter: 50gb storage, priority support, early access

automatic renewal

subscriptions automatically renew unless canceled before the renewal date. you may cancel at any time through your account settings.

5. acceptable use policy

you may use the services only for lawful purposes. prohibited activities include:

• violating laws or third-party rights
• uploading malware or malicious code
• generating illegal, abusive, or harmful content
• attempting to bypass security measures
• scraping or unauthorized data extraction
• sharing account credentials

6. ai services and disclaimers

your responsibility for ai outputs

critical: you are solely responsible for reviewing and validating all ai-generated content. do not rely on ai outputs without independent verification.

ai disclaimers

ai models may produce inaccurate, incomplete, biased, or inappropriate responses. ai outputs do not constitute professional advice (legal, medical, financial, etc.). consult qualified professionals for such advice.

your use of ai models is subject to the terms of the ai providers (openai, anthropic, google, openrouter).

ai training

we do not use your personal information to train ai models. however, ai providers may use your data according to their own policies.

7. limitation of liability

to the maximum extent permitted by law, arbor is not liable for indirect, incidental, special, consequential, or exemplary damages, including:

• loss of profits, revenue, or data
• damages from ai outputs or actions
• service interruptions or errors

our total liability shall not exceed the greater of amounts you paid in the last 12 months or $100.

8. dispute resolution and arbitration

disputes will be resolved by binding arbitration in santa clara county, california, except for small claims court disputes or claims for injunctive relief. you waive the right to participate in class actions.

you may opt out of arbitration by emailing legal@arbor.xyz within 30 days of accepting these terms.
